Terms of service.

What we provide, what we ask of you, and how either side can end it.

Last updated 31 August 2026

1. The agreement

These terms govern your use of Optimizly, operated by Multichoice Agency. By creating an account you accept them. If you accept on behalf of a company, you confirm you are allowed to bind it, and “you” means that company.

2. What the service is

Optimizly brings your website analytics, advertising performance and content together in one place. You register a website, connect the marketing platforms you already use, and we retrieve reporting from them and return conversions to them so your campaigns can be measured and optimised.

We read your advertising data and send conversions back. We do not create, edit, pause or delete campaigns, and we do not change budgets or bids. Anything spent on those platforms is spent under your agreement with them, not with us.

3. Your account

Keep your credentials to yourself and tell us promptly if you think someone else has them. What happens under your account is your responsibility. You must be old enough to enter a contract in your country and give us accurate details.

4. Connected platforms

You connect Google, Meta, TikTok, LinkedIn or Pinterest yourself, and by doing so you confirm you are entitled to grant access to those accounts. Each platform has its own terms; those keep applying, and we have no say over them. A platform can change its API, restrict access or withdraw a permission at any time, and if that breaks a feature we will say so rather than pretend otherwise.

5. What we ask of you

Do not use Optimizly to:

  • break the law, or a platform’s own rules
  • upload content you have no right to use
  • attack, overload or probe the service, or work around its limits
  • resell or repackage the service without our written agreement
  • track people who have not been told about it, where the law requires telling them

You are responsible for having a lawful basis to collect data on your own website, and for telling your visitors about it. Our privacy policy sets out our side of that.

6. Your content and data

Your data stays yours. You grant us only the permission needed to run the service for you: to store it, process it and show it back to you. We do not use it to train models, we do not sell it, and we do not mix it into datasets shared with other customers.

7. Our software

The platform, its design and its code stay ours. You get a limited, non-exclusive, non-transferable right to use it while your subscription is active. Feedback you send us we may use freely to improve the product.

8. Plans and payment

Paid plans are billed in advance for the period you choose, and renew automatically until you cancel. Prices are in euros and exclude VAT unless stated otherwise. Cancel any time and your plan runs to the end of the paid period; we do not refund part of a period unless the law says we must. If a payment fails we may suspend the account after telling you.

We can change prices, but not before telling you at least 30 days ahead of your next renewal.

9. Availability

We work to keep Optimizly available, but we do not promise it is never interrupted. Maintenance, third-party outages and platform API failures happen. We announce planned maintenance in advance where we can.

10. Liability

The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, for lost profit or revenue, or for decisions you take on the basis of the figures shown. Our total liability in any twelve-month period is limited to what you paid us in that period.

Nothing here limits liability that cannot be limited by law, including for intent or deliberate recklessness on our part.

11. Ending it

You can close your account whenever you want, from your account settings. We can suspend or close an account that breaches these terms, and we will tell you why unless the law prevents it. When an account closes, its data is deleted as described in the privacy policy. Export what you want to keep before you close it.

12. Changes to these terms

We may update these terms. The date at the top of this page shows when we last did. For material changes we tell you at least 30 days in advance; continuing to use the service after that means you accept them.

13. Law and jurisdiction

Dutch law applies, and disputes go to the competent court in the Netherlands. If a provision here turns out to be invalid, the rest stays in force.

14. Questions
